This page explains what Daily's games show of other people's work, why, and how to have something removed. It applies to Songless Unlimited and Bandle Unlimited, and to anything else on Daily that shows a third-party work.

What the games show, and what they do not

Each game asks one question: can you identify this work? To ask it, the game shows a small excerpt and nothing more.

Songless Unlimited and Songspot play a short official preview clip of a recording, streamed by a third-party service. Daily does not host, copy or cache the audio: each game only controls how much of the preview a player hears before guessing, starting at a tenth of a second.
Bandle Unlimited plays a short excerpt of a recording, at most fifteen seconds, one part of the mix at a time, so that a player can build the song up part by part. The parts are made in the player's own browser from the streamed preview; Daily hosts no audio. No excerpt is offered for download, and no full recording is available through Daily.

In every game the excerpt is the question. It is a small fraction of the work, it is not a substitute for the work, it is not offered for sale or download, and it is never available outside the game. Daily does not sell, license or claim ownership of any recording, composition or artwork. Cover art and titles are shown only to identify the work. No work is featured, promoted, sold or recommended, and nothing on Daily grants anyone any right in a recording, composition or artwork.

Daily's position is that this is fair use under United States law and fair dealing under Canadian law: the use is for identification, commentary and play, it is transformative, it takes a small part of each work, and it does not compete with the market for the work. Daily also respects that a rights holder may see it differently, which is what the rest of this page is for.

Daily is not partnered with, sponsored by or endorsed by any music service, record label, publisher or artist, and none of them has any control over or responsibility for Daily.

Removing a work

If you own or control the rights to a work shown on Daily and want it removed, tell us. You do not need a lawyer and you do not need a formal notice: an email from an address at the rights holder's domain, naming the work and the game, is enough for us to act. We remove first and discuss afterwards.

Send it to legal@playdaily.org, or use the report form, which every game links to. A removed work stays removed. It is not re-added when the catalog is rebuilt. Daily may also remove any work, or any game, at any time and for any reason without notice.

Formal notices

If you prefer to send a formal notice under the United States Digital Millennium Copyright Act (17 U.S.C. 512) or the notice provisions of the Canadian Copyright Act, our designated agent for such notices is:

A notice under the DMCA should include:

Identification of the copyrighted work you believe is infringed, or a representative list if the notice covers several works
Identification of the material you want removed, with enough detail for us to find it: the game, and the song or artist
Your name, address, telephone number and email address
A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent or the law
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorized to act for the rights holder
Your physical or electronic signature

We act on complete notices promptly, normally within one business day, by removing or disabling access to the material identified, and we confirm by email. Knowingly making a false claim of infringement can make you liable for damages under section 512(f) of the DMCA.

Counter-notices

If material was removed on a notice and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the same address. It should include identification of the material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, your name, address and telephone number, a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the United States, any district in which Daily may be found) and that you will accept service from the person who sent the notice, and your signature. We forward counter-notices to the original complainant and may restore the material after ten business days unless we are told that a court action has been filed.

Repeat infringers

Daily does not host material uploaded by users, so there is no user content to police. Should that change, Daily will terminate the accounts of users who repeatedly infringe.

Trademarks and other games

Daily is not affiliated with, endorsed by or sponsored by any other game, studio, publisher, record label or company. Names such as "Songless", "Bandle", "Heardle", "MapTap", "Poople" and "Krillion" belong to their owners and appear on Daily only to identify a kind of game or to compare it with our own. Songless Unlimited, Bandle Unlimited, MapTap Unlimited, Poople Unlimited, Krillion Unlimited and Silverbrook are Daily's own designs, code and copy, and are not ports, copies or official versions of anyone else's game.
