Terms of Service

These Terms of Service ("Terms") govern your use of https://playdaily.org and related services (the "Services") operated by Daily ("Daily", "we", "us", or "our").

By using Daily, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old and allowed to use the Services under applicable law.

2. Accounts

You may sign up with email/password or Google OAuth. Keep your account secure. Do not share accounts or create multiple accounts to manipulate rankings or limits.

We may suspend or terminate accounts that violate these Terms. You may request account deletion by contacting support@playdaily.org.

3. Free Features

Daily's core competitive loop is free: the daily puzzle, casual and competitive play, World Rankings, profile stats, and skill tracking. The free experience is supported by advertising.

4. Daily Pro

Daily Pro unlocks the puzzle archive and saved archive scores, and removes advertising while you are signed in to the entitled account. It may be offered as a yearly subscription or a lifetime purchase. Feature details are shown on the Plans page.

5. Payments

  • Payments on the web are processed by Stripe.
  • Yearly subscriptions renew automatically unless canceled.
  • Lifetime access is a one-time purchase.
  • You can manage or cancel web subscriptions through account settings or the Stripe billing portal.
  • Canceling a subscription stops future renewals but does not refund the current period.
  • Lifetime purchases and partial subscription periods are non-refundable unless required by law.

Prices are shown on the Plans page. We may change prices with notice where required. Lifetime plan holders will not be charged again for features included in their purchase.

6. Fair Play and Acceptable Use

You agree not to:

  • Use bots, scripts, automation, or external solvers
  • Cheat, exploit bugs, or manipulate leaderboards
  • Share competitive puzzle solutions during active periods
  • Harass, abuse, or impersonate others
  • Attempt unauthorized access to Daily systems
  • Scrape, crawl, or bulk-download game catalogs, media, or other assets
  • Download, record, extract, or redistribute any audio, artwork, or image shown in a game
  • Copy or redistribute Daily content without permission

Violations may lead to score removal, leaderboard adjustment, account suspension, or a permanent ban without refund.

7. Contributions and Feedback

If you submit puzzle ideas, feedback, or suggestions, you allow Daily to use them without compensation or obligation. If you ask to be credited, we may credit your Daily username if we use the idea.

8. Intellectual Property

Daily owns the Services, including game implementations, code, designs, branding, and original content. You may use Daily for personal, non-commercial play. You may not copy, modify, sell, or redistribute the Services without permission.

Daily is not affiliated with, endorsed by, or sponsored by any other game or company named on the site. Third-party names and marks belong to their owners and are used only nominatively, to identify a genre or to compare it with our own games.

Brief excerpts of third-party works shown in Songless Unlimited, Songspot, and Bandle Unlimited remain the property of their rights holders. They are shown only so that a player can try to identify the work, and you may not download, extract, record, or reuse them. Nothing in these Terms or on the Services grants you any right or license in any third-party work. See the Disclaimer and the Copyright Complaints section below.

9. Third-Party Services

Daily uses third-party services including:

  • Stripe for web payments
  • Supabase for database and authentication
  • Google for OAuth, reCAPTCHA, Analytics, and Sheets submissions
  • Journey by Mediavine for advertising and the Grow widget
  • Vercel for hosting and analytics
  • Cloudflare for content delivery
  • Sanity for stories and articles
  • Third-party services that deliver some of the media shown in our games

Your use of those services may be subject to their own terms and policies. Daily does not control them and is not responsible for their content, availability, terms, or conduct.

10. Copyright Complaints

Daily respects the intellectual property of others and removes material promptly when a rights holder asks. If you believe a work shown on Daily infringes your copyright, send a notice to legal@playdaily.org, our designated address for notices under the U.S. Digital Millennium Copyright Act and the notice provisions of the Canadian Copyright Act. Include:

  • The work you believe is infringed and, if you are not its owner, evidence of your authority to act for the owner
  • The URL or page on Daily where the material appears, with enough detail for us to find it
  • Your name, address, email address, and telephone number
  • A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law
  • A statement, under penalty of perjury where applicable, that the information in the notice is accurate
  • Your physical or electronic signature

We will review the notice, remove or disable access to the material identified, and reply to you, normally within one business day. A formal notice is not required: an email from the rights holder naming the work and the game is enough for us to act. Knowingly misrepresenting that material is infringing may expose you to liability under section 512(f) of the DMCA.

Counter-notices, our position on fair use and fair dealing, our repeat-infringer policy and the details of what each game shows are in the Copyright and Takedown Policy, which forms part of these Terms.

11. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Daily disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted service, error-free gameplay, permanent data preservation, or perfectly accurate rankings.

Daily may change, suspend, remove, or discontinue any game, feature, catalog entry, or other content at any time, with or without notice, and without liability to you.

Daily is not responsible for third-party content shown in or linked from the Services, or for the terms, availability, or conduct of any third-party service.

12. Limitation of Liability

To the maximum extent permitted by law, Daily is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, however caused and even if Daily was told such damages were possible. This applies to every kind of claim, including claims relating to third-party content or services. Our total liability for all claims together will not exceed the greater of the amount you paid Daily in the past 12 months or $100 USD.

Some jurisdictions do not allow some of these limits. Where that is the case, they apply to the fullest extent the law allows, and nothing in these Terms limits any right you have under mandatory consumer protection law where you live.

13. Indemnification

You agree to indemnify and hold harmless Daily and its operators from any claim, loss, or expense, including reasonable legal fees, arising from your use of the Services, anything you access through the Services, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of Canada, without regard to conflict of law rules. Before filing a claim, contact legal@playdaily.org so we can try to resolve it informally; most issues are settled that way within a few days. Any claim that cannot be resolved informally must be brought in the courts of Canada, and you consent to their jurisdiction.

To the extent permitted by applicable law, any claim relating to the Services must be brought within one year of the events giving rise to it, and you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

15. Termination

We may suspend or end the Services, any game, or your access to them at any time, with or without notice, for any reason, including a change in what a third-party service makes available. If we permanently end the Services before the end of a prepaid subscription period, we will refund the unused portion of that period, and that refund is your only remedy. Sections 8 and 10 through 16 survive termination.

16. General

These Terms, the Privacy Policy, the Disclaimer, and the Copyright and Takedown Policy are the entire agreement between you and Daily about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver of it. You may not assign these Terms; Daily may assign them to a successor operator of the Services. Headings are for convenience only.

17. Changes

We may update these Terms. Continued use after changes means you accept the updated Terms.
